Americans with Disabilities Act (ADA) Federal Requirements

The Palm Beach TPA is required by federal agencies to sign assurances that all recipients of federal funds allocated by the TPA have ADA transition plans in place. ADA transition plans outline a jurisdiction’s assessment and plans for bringing their infrastructure into compliance with the requirements of the Americans with Disabilities Act (ADA).

The TPA has created a document summarizing the ADA Transition Plan Requirements for recipients of TPA Federal Funding (PDF).

ADA Transition Plan Training

As a demonstration of the Palm Beach TPA’s commitment to assist local governments to comply with ADA Transition Plan requirements for sub-recipients of federal funds including TPA transportation funding allocations, the TPA hosted a training workshop on Oct. 11, 2018. The training was conducted by Dean Perkins, the ADA Coordinator for the Florida Dept. of Transportation (FDOT).

Nondiscrimination Policy & Complaints

Title VI of the 1964 Civil Rights Act, the Civil Rights Restoration Act of 1987 and the Florida Civil Rights Act of 1992 prohibit discrimination on the basis of race, color, national origin, sex, age, disability, religious status and other protected classes relative to programs, services, benefits or activities offered by the Palm Beach TPA. The Palm Beach TPA will not exclude from participation in, deny the benefits of, or otherwise subject anyone to discrimination or retaliation under any offered program, service, benefit or activity, irrespective whether those offerings are federally funded or non-federally funded.

The Palm Beach TPA has designated a Title VI & ADA Officer who is responsible for addressing complaints of discrimination in the provision of programs, services, benefits or activities. Complaints may be submitted in writing using the Complaint Form.

The TPA’s Title VI and ADA Nondiscrimination Policy and Plan was adopted on February 15, 2018. The Plan, the official complaint form, and the TPA’s Title VI/Nondiscrimination Policy Statement can be downloaded below.

Limited English Proficiency (LEP) Plan

The TPA’s LEP Plan ensures individuals with limited English proficiency have meaningful access to the transportation planning process. The LEP Plan was adopted on March 16, 2023 and can be viewed and downloaded below.
